Long-term Disability.

If your LTD claim has been denied or cut off, you don’t have to accept the decision.

Why valid claims get denied

You pay your premiums for one reason: to be protected when chronic illness, a mental health condition, severe orthopedic injury, or cognitive impairment keeps you from working. Insurance companies routinely deny valid claims anyway. The patterns are predictable:

  • “Lack of objective medical evidence.” A common framing for “we don’t think your doctor’s records prove enough.”
  • The 2-year shift. Most LTD policies change the definition of “disabled” after 24 months, from being unable to do your own job to being unable to do any suitable job. Insurers use the shift to cut benefits off.
  • Surveillance and social media. Filming you on errands, scraping photos from your accounts, and reframing minor activities as proof you’re fine.

When your claim is denied, the insurance company will often suggest you file an internal appeal. It sounds reasonable. Here’s the comparison.

Internal appealLegal action with a lawyer
Reviewed by the insurer’s own staff.Reviewed by an independent court
The insurer uses the time to gather more material to justify their denial. The insurer has to lay out the full file for scrutiny.
The clock on your statutory deadlines keeps running. The clock is stopped by the lawsuit.

The internal appeal can occasionally work. More often, it costs you time you can’t get back.

Your questions, answered.

Timelines vary with the injury and the insurer. Straightforward Accident Benefits claims can move in months. Tort claims and long-term disability disputes typically run longer, sometimes a year or more, especially where medical evidence is being contested. Catastrophic injury files run longest because the settlement has to account for a lifetime of care. We’ll give you an honest estimate once we’ve reviewed your file.

You pay nothing up front, and you pay legal fees only if we recover compensation for you through a settlement or court award. We cover the disbursements for building your file (medical records, expert reports, and so on) as we go, and those come out of the settlement at the end. If there is no recovery, you owe nothing. Our fee is agreed with you before we start.
